If you are looking for delivery in a country outside of the regions listed in the Scope of Application section, please be aware that these Terms & Conditions may not apply, and you will need to arrange shipment independently.

References to the "Company" or "we/us" throughout this document refer to the legal entity operating the Maginista brand.
Maginista v/ FMK ApS (hereinafter, the “Company”) is a company organized under the laws of Denmark, with a registered office located at Bredgade 12, Copenhagen, 1260, DK.

Scope of Application
These are the official Terms and Conditions of Sale (hereafter the “Terms and Conditions”) which apply to all sales of Maginista Products (hereafter the “Products”) purchased by final consumers (for personal use only) on the Maginista website, [https://www.maginista.com] (hereinafter the "Website").
This Website is controlled and operated by the Company and primarily targets consumers located in the following European countries: Austria, Belgium, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Luxembourg, Netherlands, Poland, Portugal, Spain, Sweden and UK, continental USA and Canada, Cyprus, Malta, Norway.
You are responsible for ensuring that you reside in a country and region where we can legally deliver the Products.
All sales are subject to these Terms and Conditions, which you expressly accept when placing an order. The Euro (€) remains the applicable currency for all orders.
We may modify or update these Terms and Conditions at any time; the version applicable to your order is the one in force on the day you place the order. These Terms and Conditions form an integral whole with our Terms and Conditions of Use, our Privacy Policy, and our Cookies Policy.
Product Information and Availability
We take the utmost care to ensure the maximum accuracy regarding the information (descriptions, images, composition, etc.) of the Products offered on the Website. However, non-substantial errors may occasionally occur. Photographs and reproductions, while aiming to be faithful, may also contain minor errors due to technical limitations.
Products are offered for sale only within the limits of their availability. If a Product you ordered is permanently unavailable, we will inform you immediately and promptly refund the amount paid.
Ordering Products
General Requirements
Products are intended for final consumers for private and personal use only. Purchase for business or resale purposes is expressly prohibited.
To place an order, you must be of legal age, have the legal capacity to contract, and hold a valid payment instrument accepted on the Website. You warrant that all information you provide to us is accurate and up to date. We reserve the right to refuse or cancel any order that is not compliant with these Terms and Conditions or where there is an outstanding payment dispute.
Placing an Order
- Selection: Select your Product(s), quantity, and variant (size, etc.), and click “ADD TO CART.”
- Verification: Review your shopping cart. You may modify quantities or remove items. The final price and availability will be confirmed upon moving to checkout.
- Validation: Click "PROCEED TO CHECKOUT" and provide your account login or guest details (name, email, addresses). You must then confirm the delivery address, billing address, shipping method, and payment method.
- Promotions: You may enter a valid promotional code, ensuring your order meets all stated terms (e.g., minimum order, non-stackable).
- Final Review & Acceptance: Before processing payment, you will review the final order summary (including shipping and applicable taxes). You must expressly accept these Terms and Conditions by checking the designated box and clicking the "COMPLETE ORDER" button to submit your binding offer.
- Acknowledgement: You will immediately see your order number displayed and receive an email acknowledging receipt of the order.
- Contract Acceptance: The sales contract becomes binding once you receive a subsequent email from us confirming the order's acceptance.
- Dispatch: We will send a final email when your Product(s) are dispatched with tracking information.
Price of the Products
Prices are displayed in Euros (€) and include any applicable sales tax. The final price, including delivery costs, will be clearly displayed before you submit your order.
We reserve the right to adjust prices, offers, and specifications at any time. If an error is discovered in the price or description of a Product you ordered, we will inform you and allow you to proceed at the correct price or cancel your order. We are not obliged to supply Products at the incorrect price. Any adjustment in price will not affect the price of any Products which you have already ordered and which the Company has accepted.
Payment
Purchases must be paid for using a credit or debit card, or any other payment method indicated on the Website (e.g., Visa, Mastercard, PayPal).
Your payment card will be debited only after verification of the details. If payment is declined, the order will be cancelled. We reserve ownership of the Products until the full price has been successfully paid.
Delivery
Products will be delivered to the address you specify, provided it is in one of the approved delivery countries (see Scope of Application). We are not responsible for missing or erroneous delivery information provided by you.
We will dispatch the Products using a carrier of our choice on or within the estimated timeframe indicated in the confirmation email. We are not liable for delays arising from circumstances beyond our reasonable control (force majeure). Title to the Products transfers to you upon delivery.
Right of Withdrawal and Returns
You have the right to return any item ordered on the Website within 30 calendar days from the receipt of the Products (or from the receipt of the last item in a multiple-product order).
Return Procedure:
- Notify us of your decision to return via the return form on the Website.
- Return the Products within thirty (30) calendar days of your notification.
- Products must be returned in their original packaging, unused, in perfect re-sellable condition, and with all accessories, documents, and promotional gifts (if applicable).
- You will bear the direct costs of returning the items. We advise keeping proof of postage.
We reserve the right to reject returns for items that are used, damaged, unsealed (where prohibited for hygiene reasons), or marked as "final sale."
Refunds will be processed back to the original payment method within fourteen (14) days from the date we receive the returned Product.
Legal Warranty in the European Union
Customers in the European Union are entitled to a legal warranty for non-conforming or defective products, which is generally for a period of two to three years from the date of delivery, as provided by national laws transposing EU Directives 2019/771 and 2019/770.
Legal Warranties for Non-EU Consumers
Customers outside the EU will benefit from the legal warranties set out by their corresponding local laws. These Terms and Conditions do not affect your mandatory consumer rights.
Discounts, Offers, and Promotions
Discount codes are unique to the recipient, non-transferable, and have no monetary value. They must be used before any stated expiration date.
Only one discount code may be used per order. If you return an item purchased with a promotion, the refund will be reduced by the pro-rated value of the discount applied to that item. Discounts cannot be refunded. We do not offer price adjustments on sale items.
Intellectual Property Rights
All intellectual and industrial property rights related to the Website content, design, trademarks, logos, texts, images, and software (collectively, the "Intellectual Property Rights") are the exclusive property of the Company or have been licensed to the Company.
You are strictly prohibited from using, reproducing, distributing, or exploiting any of the protected elements without our prior express written consent. You agree to comply with our Website's Terms and Conditions of Use.
Personal Data
The personal data we collect is limited to the data necessary to register you on the Website and process your order(s). Your data is governed by the Maginista Privacy Policy.
Liability
To the maximum extent permitted by law, and without affecting your consumer rights, the Company is not liable for (i) losses not attributable to our breach, (ii) business losses, or (iii) any indirect or consequential losses that were not reasonably foreseeable.
Nothing in these Terms and Conditions limits our liability for fraud, misrepresentation, or for death or personal injury caused by our negligence or willful misconduct.
Miscellaneous
The Company is not liable for delay or failure to perform any obligation due to events beyond our control (e.g., strike, war, pandemic, natural disaster). If such an event continues for more than thirty (30) days, either you or the Company may cancel the affected order(s), and you will be reimbursed.
If any provision of these Terms and Conditions is declared null or void, the remaining provisions will remain in full effect.
Competent Jurisdiction and Applicable Law
These Terms and Conditions are governed by and construed in accordance with the laws of Denmark. Any disputes arising from or related to these Terms and Conditions shall be submitted to the non-exclusive jurisdiction of the courts of Denmark.
However, this does not affect any rights consumers may have under the mandatory consumer protection laws of their country of residence, which may allow them to bring claims in their home jurisdiction.
